Now this is an interesting one. On one hand - yes, this violates the separation of church and state.... but I would say that is only violated if the judge made it maditory to attend 'church'. If the person was allowed to attend their own religious place of worship, be it Buddhist, Jewish, Hindu, Islamic, Christian, or whatever, that may be a different story.

Either way though, it's a very fine line. Once the taxpayers' money is involved....
